The village of Indian Point has been found to have violated the Sunshine Law in regards to a 2022 request for records related to legal actions involving the village.
Village resident Susan Baker filed a Sunshine Law request on Oct. 21, 2022, asking for “records regarding any legal actions, causes of action or litigation involving the Village of Indian Point in the last 10 years. Any minutes, vote or settlement agreement including the amount of monies paid.” The request also asked for any votes on final decisions in those matters and how each member of the village leadership voted regarding the employment of former employees.
The village clerk notified Baker’s attorney, Scott Hall, on Oct. 25, the request was a “personal interest rather than a public interest” under the Sunshine Law and the clerk would get back with Hall regarding a cost estimate for the request and a viewing time. Hall responded three days later he felt the village’s request did not comply with the state’s Sunshine Law. He requested a copy of the Village’s Sunshine Law Policy and requested information as to the village’s Custodian of Records.
